Terms of Service.

The agreement between you and I Am Violet, Inc. governing your use of Violet Desk. Please read carefully — by signing up, you agree to these terms.

The short version. Pay $399.99/month for an AI receptionist. Cancel any time. We do our best to make Violet work for you; you're responsible for using her legally and reasonably. We're not liable for amounts above what you paid us. US law applies; Delaware courts decide disputes.

1. Acceptance.

By signing up for, accessing, or using Violet Desk (the "Service"), you agree to these Terms of Service ("Terms") and our Privacy Policy. If you don't agree, don't use the Service.

You confirm that you are authorized to bind your business to these Terms and that you are at least 18 years old.

2. The service.

Violet Desk is a voice-AI service that answers your business phone, books appointments in your connected calendar, sends SMS confirmations to your customers, and provides a dashboard of call activity. The Service is operated by I Am Violet, Inc., a Delaware corporation.

3. Account & eligibility.

You must provide accurate signup information and keep it current. You're responsible for safeguarding your account credentials. You must use the Service for legitimate business purposes only. The Service is intended for US-based businesses; international availability may be limited.

4. Subscription, fees, & billing.

Receptionist plan.

$399.99 per month, charged to your card on the day you sign up and on the same date each month thereafter. Includes unlimited inbound calls, outbound confirmations, calendar booking, SMS to customers, and dashboard. Up to 1,500 voice minutes per month included; usage above that billed at $0.05 per minute.

Brand add-on.

$199.99 per month additional, available when launched (planned Q3 2026). Adds website + promotional materials creation. Bundle total: $599.98 per month.

Authorization.

By providing payment information, you authorize us to charge your card on a recurring monthly basis until you cancel. You can update payment information any time by emailing billing@iamviolet.com.

Failed payments.

If a payment fails, we'll retry up to three times over seven days. If all retries fail, the Service is paused; your account data is preserved for 90 days, after which it may be deleted.

5. Cancellation & refunds.

You can cancel any time by emailing cancel@iamviolet.com or from your account dashboard. Cancellation takes effect at the end of the current billing period. See our Refund Policy for the 30-day money-back guarantee details.

6. Acceptable use.

You agree not to:

  • Use the Service for unlawful, fraudulent, harassing, or abusive purposes
  • Use the Service for telemarketing, robocalling, or any activity prohibited by the Telephone Consumer Protection Act (TCPA) or similar laws
  • Attempt to reverse-engineer, scrape, or replicate the Service
  • Resell or sublicense the Service without our written permission
  • Use the Service to record calls in violation of two-party consent laws in your jurisdiction
  • Interfere with or disrupt the Service's infrastructure
  • Use the Service to impersonate a different business or person

We may suspend or terminate accounts that violate this section.

7. Your responsibilities for calls and recordings.

You are responsible for:

  • Ensuring you have legal authority to forward your business phone line to Violet
  • Complying with all applicable telecommunications, recording-consent, and privacy laws in your jurisdiction
  • Configuring Violet's recording-disclosure script appropriately for your state and business
  • The accuracy of calendar information, services offered, prices, and policies you provide to Violet
  • Following up on calls Violet escalates to you in a timely manner
  • Notifying your customers as required by law about how their data will be used

8. Service availability.

We aim for 99.5% uptime, measured monthly. The Service depends on third-party providers (Twilio, Stripe, calendar providers, internet infrastructure); we are not liable for outages caused by them. Scheduled maintenance will be announced when possible. No SLA credits are provided in the standard plan; enterprise SLAs are available on request.

9. HIPAA.

Standard accounts are not HIPAA-compliant. Medical, dental, and mental-health practices must execute a Business Associate Agreement with us before any patient call data flows through the Service. Contact hipaa@iamviolet.com to request a BAA.

10. Intellectual property.

Violet Desk — including the software, voice models, brand, designs, and documentation — is owned by I Am Violet, Inc. and protected by US and international intellectual-property laws. We grant you a non-exclusive, non-transferable license to use the Service during your active subscription. You retain ownership of your business data and call content.

11. Disclaimer of warranties.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT VIOLET WILL HANDLE EVERY CALL CORRECTLY.

12. Limitation of liability.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, OR LOST DATA, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

13. Indemnification.

You agree to indemnify and hold harmless I Am Violet, Inc., its officers, directors, employees, and agents from any claim or demand, including reasonable attorneys' fees, arising out of: (a) your use of the Service in violation of these Terms; (b) your violation of any law or third-party right; or (c) call content or business operations that are your responsibility under Section 7.

14. Termination by us.

We may suspend or terminate your account at any time for material breach of these Terms, fraud, abuse of the Service, non-payment, or as required by law. We will notify you and provide an opportunity to cure where reasonable.

15. Governing law & disputes.

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law provisions. Disputes will be resolved exclusively in the state or federal courts located in Delaware. You waive any objection to venue or jurisdiction in those courts.

16. Changes to these terms.

We may update these Terms from time to time. Material changes will be communicated by email at least 30 days before they take effect. Your continued use of the Service after the change indicates acceptance.

17. Entire agreement.

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding the Service and supersede prior agreements.
